Kennedy has represented agriculture, mining, chemical and the oil & gas industry on several environmental issues over the years. Kennedy has experience with all stages of the federal rulemaking process, from proposed rules to Supreme Court litigation.  Most notably while at the National Mining Assoc., he was involved in winning Supreme Court stay on the implementation of the Environmental Protection Agency’s (EPA) Clean Power Plan.


While at the Agricultural Retailers Assoc., Kennedy represented the agricultural supply industry during the accident in West, Texas on April 17, 2013. As a result on August 1, 2013, President Obama issued Executive Order 13650 Improving Chemical Facility Safety and Security. The EPA is proposing to amend the Accidental Release Prevention Requirements of Risk Management Programs (RMP) under the Clean Air Act, Section 112(r)(7) in its new advance notice for propose rule. The significant changes to its RMP rule includes new mandates for third-party RMP compliance audits, safer alternatives and feasibility analysis, and expanded information sharing and public meetings.


He’s testified before numerous agencies including the EPA, U.S. Chemical Safety & Hazard Investigation Board, National Fire Protection Agency, White House Office of Management and Budget.
